I. General Information

  1. The controller of personal data collected via the website figarogarden.pl is FIGARO GARDEN sp. z o.o., with its registered office in Kraków, address: ul. Koszykarska 29, 30-717 Kraków, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0001075186, NIP 6793285502, REGON 527189096.
  2. Data protection is carried out in accordance with the requirements of generally applicable laws, in particular the Act of 18 July 2002 on Providing Services by Electronic Means, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”).
  3. We respect the right to privacy and ensure the security of personal data. For this purpose, we use, among other things, a secure SSL encrypted communication protocol, and personal data is stored on secured servers.
  4. Personal data provided in the contact form is treated as confidential and is not visible to unauthorized persons.

II. Personal Data Administration

  1. FIGARO GARDEN sp. z o.o. is the controller of its clients’ data. This means that if a user uses the contact forms on our website or sends emails to employees, we process such data as: first name, last name, email address, phone number, address, IP address, company name, tax ID (NIP), and any other data provided by the User. The controller does not process special categories of data.
  2. Personal data is processed:
    1. in accordance with personal data protection laws,
    2. in accordance with the implemented Personal Data Security Policy,
    3. to the extent and purpose necessary to establish, amend, or terminate the Agreement and for proper provision of electronic services,
    4. to the extent necessary to fulfill legitimate interests, provided such processing does not violate the rights and freedoms of the data subject;
    5. data provided in the form is processed for the purpose specific to that form, e.g. for commercial contact.
    6. Data is collected only to an adequate, necessary, and essential extent for the purposes for which it is processed.
  3. Every person whose data is processed has the right to access their data, rectify it, delete it, restrict processing, the right to object, and the right to lodge a complaint with a supervisory authority.
  4. Contact with the person supervising personal data processing is possible via email at figarogarden@wisdomic.pl or in writing to FIGARO GARDEN sp. z o.o., ul. Koszykarska 29, 30-717 Kraków, with the note “Personal Data”.
  5. We reserve the right to process data after termination of the Agreement or withdrawal of consent only to the extent necessary to pursue potential claims before a court or if national, EU, or international regulations require us to retain the data.
  6. Personal data may be deleted as a result of withdrawal of consent or submission of a legally permissible objection to data processing.
  7. The controller makes every effort to protect data against unauthorized access by third parties and applies high-level organizational and technical security measures.
  8. To maintain, develop, and analyze relationships with Users, and to create statistics and market FIGARO GARDEN sp. z o.o. products and services, we use profiling to assess certain characteristics of the User, especially preferences, interests, location, or movement.
  9. Personal and usage data of users may be disclosed to external entities, such as:
    1. Data processors to whom FIGARO GARDEN sp. z o.o. has entrusted data processing, e.g. renovation, construction, or IT service providers, where necessary for the performance of a contract with the data subject;
    2. state authorities such as the police, prosecutor’s office, courts, or regulators — upon request and only as legally required or to protect the rights or safety of FIGARO GARDEN sp. z o.o., users, or employees;
    3. law firms and courts for enforcing or performing a contract with the User;
  10. The User’s data is not, by default, transferred outside the European Economic Area nor disclosed to international organizations. If data is transferred to third countries, we use the European Commission’s standard contractual clauses.
  11. Our website may include social media features such as Facebook, Instagram, LinkedIn, or Twitter buttons. These may collect information such as IP address or browsing history and may place cookies. Processing of such data is subject to the policies of the social media providers and is not covered by this Privacy Policy.
  12. We strive to minimize the storage period of personal data that is no longer needed. However, longer retention may occur for operational or technological reasons.
  13. Data will be processed for marketing purposes until the User withdraws consent.
  14. For the performance of a contract or services, data will be processed for the duration of the contract or services and, if justified, afterward only if permitted by law, e.g. for statistical or accounting purposes or for claim handling.

III. Cookies

  1. The Service uses “cookies”. These are small text files sent by a web server and stored by the browser software on the user’s device.   • Google Ads (previously Google AdWords)

a) tool description

We use Google Ads to draw users’ attention to our offer through advertisements displayed on external websites. Google Ads uses server cookies, which typically expire after 30 days and do not identify the User. We do not collect or process personal data through these tools — we only receive statistical data. IP anonymization is active to prevent identifying users.

b) Google Ads remarketing
